Terms of Service — Günther AI

1. Acceptance

By creating an account or using Günther AI (“the Service”), you agree to these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Permitted Use

You may use the Service for lawful purposes only. You must not:

Use the Service to generate content that is illegal, harmful, or violates the rights of others.
Attempt to reverse-engineer, scrape, or abuse the API in ways that exceed your plan limits.
Share API keys or account credentials with unauthorised parties.
Use the Service to train or fine-tune competing AI models without our written consent.

3. Plans & Billing

The Service is offered on a free tier and paid subscription plans. Paid plans are billed monthly via Creem. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

4. AI-Generated Content

AI responses are generated by large language models and may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and validating any AI output before relying on it. We do not warrant the accuracy, completeness, or fitness for purpose of any AI-generated content.

5. Intellectual Property

You retain ownership of content you submit to the Service. You grant us a limited licence to process that content solely to provide the Service. We retain all rights to the platform, API, and underlying technology.

6. Limitation of Liability

To the maximum extent permitted by law, Günther AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability in any month shall not exceed the amount you paid us in that month.

7. Service Availability

We provide the Service “as is” and make no warranty of uptime or availability. We may modify, suspend, or discontinue the Service at any time with reasonable notice.

8. Termination

We may suspend or terminate your account for material breach of these terms, including abuse of the Service. You may delete your account at any time from account settings.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the jurisdiction of the South African courts.
